Special counsel Jack Smith argues in a new court filing that former President Donald Trump is not immune from prosecution for his conduct immediately after the 2020 presidential election.

Special counsel Jack Smith is continuing efforts to prosecute Donald Trump, as the Republican faces Vice President Kamala Harris in the presidential election.

“It doesn’t matter if you won or lost the election,” the filing quotes Trump as saying. “You still have to fight like hell.”

Trump has not committed to accepting the results of the 2024 election, but has said he won’t run again if he loses.
